คณะนิติศาสตร์ มช. เดินหน้าขับเคลื่อนนโยบาย No Gift Policy มุ่งสร้างวัฒนธรรมองค์กรโปร่งใส สุจริต และเป็นธรรม
ผศ.ดร.ชัยณรงค์ เหลืองวิลัย คณบดีคณะนิติศาสตร์ มหาวิทยาลัยเชียงใหม่ เป็นประธานในการประชุมบุคลากรสายปฏิบัติการ เมื่อวันที่ 18 มิถุนายน 2569 เวลา 10.00 น. ณ ห้อง 1201 เพื่อสื่อสารและเน้นย้ำแนวทางปฏิบัติตามนโยบาย “No Gift Policy” ประจำปี 2569
การประชุมดังกล่าวมีวัตถุประสงค์เพื่อปลูกจิตสำนึกและสร้างวัฒนธรรมองค์กรที่เข้มแข็ง โดยมุ่งเน้นให้ผู้บริหาร คณาจารย์ เจ้าหน้าที่ และบุคลากรในสังกัดทุกคน ปฏิเสธการรับของขวัญและของกำนัลทุกชนิดจากการปฏิบัติหน้าที่ในทุกเทศกาลและทุกโอกาส (No Gift Policy) ซึ่งคณะนิติศาสตร์ได้กำหนดแนวทางปฏิบัติร่วมกัน ดังนี้:
📌 นโยบายหลัก (No Gift Policy)
ผู้บริหารและเจ้าหน้าที่ทุกคนในสังกัด “ไม่รับ” ของขวัญ ของกำนัล หรือผลประโยชน์อื่นใดจากการปฏิบัติหน้าที่ในทุกกรณี ทั้งก่อน ขณะ และหลังปฏิบัติหน้าที่
🎯 เป้าหมายของนโยบาย
- เพื่อป้องกันการทุจริตและประพฤติมิชอบในทุกมิติ
- ป้องกันการใช้ดุลพินิจหรือการตัดสินใจที่อาจนำไปสู่การเลือกปฏิบัติ หรือก่อให้เกิดผลประโยชน์ทับซ้อน (Conflict of Interest)
- ส่งเสริมและสนับสนุนให้เจ้าหน้าที่ทุกคนปฏิบัติงานด้วยความซื่อสัตย์สุจริต โปร่งใส และตรวจสอบได้
⚖️ ข้อยกเว้นการรับของขวัญ
หากมีความจำเป็นต้องให้หรือรับของขวัญตามธรรมจรรยา หรือตามปกติประเพณีนิยม บุคลากรจะต้องปฏิบัติตามกฎหมายที่เกี่ยวข้องอย่างเคร่งครัด ได้แก่:
- ระเบียบสำนักนายกรัฐมนตรี ว่าด้วยการให้หรือรับของขวัญของเจ้าหน้าที่รัฐ พ.ศ. 2565
- ประกาศคณะกรรมการ ป.ป.ช. เรื่อง หลักเกณฑ์การรับทรัพย์สินหรือประโยชน์อื่นใดโดยธรรมจรรยาของเจ้าพนักงานของรัฐ พ.ศ. 2563
💌 แนวทางปฏิบัติทดแทน
คณะนิติศาสตร์สนับสนุนและส่งเสริมให้ปรับเปลี่ยนรูปแบบการแสดงความยินดีหรือความปรารถนาดี โดยใช้ “บัตรอวยพร” หรือ “การอวยพรผ่านสื่อออนไลน์” แทนการมอบสิ่งของหรือของขวัญทางกายภาพ
คณะนิติศาสตร์ มหาวิทยาลัยเชียงใหม่ มุ่งมั่นที่จะเป็นองค์กรต้นแบบด้านความโปร่งใส โดยการร่วมใจของบุคลากรทุกระดับในการงดรับของขวัญ เพื่อขับเคลื่อนการบริหารงานและการบริการสาธารณะด้วยความซื่อสัตย์สุจริตอย่างยั่งยืน
CMU Law Drives “No Gift Policy” to Foster Transparency, Integrity, and Fairness
Assistant Professor Dr. Chainarong Luengvilai, Dean of the Faculty of Law, Chiang Mai University, presided over the operational staff meeting on June 18, 2026, at 10:00 AM in Room 1201. The primary focus of the meeting was to communicate and reinforce guidelines for the “No Gift Policy.”
The meeting aimed to cultivate awareness and establish a strong organizational culture of integrity. Executives, faculty members, and all personnel are instructed to refuse all forms of gifts and tokens of appreciation arising from the performance of their duties on all occasions and during all festivals. The Faculty has outlined the implementation guidelines as follows:
📌 Core Policy (No Gift Policy)
All executives and personnel under the Faculty “SHALL NOT ACCEPT” gifts, tokens, or any other benefits from the performance of their duties under any circumstances—before, during, or after the execution of their official responsibilities.
🎯 Policy Objectives
- To prevent all forms of corruption and misconduct.
- To eliminate the exercise of discretion or decision-making that may lead to discrimination or create conflicts of interest.
- To encourage and support all staff members to perform their duties with honesty, transparency, and accountability.
⚖️ Exceptions for Gift Acceptance
If it is necessary to give or receive gifts in accordance with ethical standards or traditional customs, personnel must strictly comply with relevant regulations, namely:
- The Regulations of the Office of the Prime Minister on the Giving or Receiving of Gifts by State Officials, B.E. 2565 (2022).
- The Announcement of the National Anti-Corruption Commission (NACC) prescribing the criteria for the acceptance of assets or other benefits on ethical grounds by state officials, B.E. 2563 (2020).
💌 Alternative Practices
The Faculty of Law encourages the transition of expressing congratulations or goodwill through “Greeting Cards” or “Online Greetings” instead of giving physical items or gifts.
