คณะนิติศาสตร์ มช. ประชุมสายวิชาการ เน้นย้ำนโยบาย No Gift Policy ร่วมสร้างวัฒนธรรมองค์กรโปร่งใส ไร้ผลประโยชน์ทับซ้อน
ผศ.ดร.ชัยณรงค์ เหลืองวิลัย คณบดีคณะนิติศาสตร์ มหาวิทยาลัยเชียงใหม่ เป็นประธานในการประชุมบุคลากรสายวิชาการ เมื่อวันที่ 12 มิถุนายน 2569 เวลา 09.30 น. ณ ห้อง 1201 เพื่อสื่อสารนโยบายและแนวทางปฏิบัติตามนโยบาย “No Gift Policy” ประจำปี 2569 แก่ผู้บริหารและคณาจารย์ประจำคณะฯ
การประชุมในครั้งนี้มุ่งเน้นการปลูกจิตสำนึกและการสร้างวัฒนธรรมองค์กรสุจริต โดยขอความร่วมมือให้ผู้บริหาร คณาจารย์ และบุคลากรในสังกัดทุกคน ปฏิเสธการรับของขวัญและของกำนัลทุกชนิดจากการปฏิบัติหน้าที่ในทุกเทศกาลและทุกโอกาส โดยมีแนวทางปฏิบัติสำคัญ 4 ด้าน ดังนี้:
📌 นโยบายหลัก (No Gift Policy)
ผู้บริหาร คณาจารย์ และเจ้าหน้าที่ทุกคนในสังกัด “ไม่รับ” ของขวัญ ของกำนัล หรือผลประโยชน์อื่นใดจากการปฏิบัติหน้าที่ในทุกกรณี ทั้งก่อน ขณะ และหลังปฏิบัติหน้าที่
🎯 เป้าหมายของนโยบาย
- เพื่อป้องกันการทุจริตและประพฤติมิชอบ
- ป้องกันการใช้ดุลพินิจหรือการตัดสินใจในการทำงานและการเรียนการสอนที่อาจนำไปสู่การเลือกปฏิบัติ หรือก่อให้เกิดผลประโยชน์ทับซ้อน (Conflict of Interest)
- ส่งเสริมให้บุคลากรทุกระดับปฏิบัติงานด้วยความซื่อสัตย์สุจริต
⚖️ ข้อยกเว้นการรับของขวัญ
หากมีความจำเป็นต้องให้หรือรับของขวัญตามธรรมจรรยาหรือตามปกติประเพณีนิยม จะต้องปฏิบัติตามกฎหมายอย่างเคร่งครัด ได้แก่:
- ระเบียบสำนักนายกรัฐมนตรี ว่าด้วยการให้หรือรับของขวัญของเจ้าหน้าที่รัฐ พ.ศ. 2565
- ประกาศคณะกรรมการ ป.ป.ช. เรื่อง หลักเกณฑ์การรับทรัพย์สินหรือประโยชน์อื่นใดโดยธรรมจรรยาของเจ้าพนักงานของรัฐ พ.ศ. 2563
💌 แนวทางปฏิบัติทดแทน
คณะนิติศาสตร์สนับสนุนและส่งเสริมให้ปรับเปลี่ยนรูปแบบการแสดงความยินดีหรือความปรารถนาดี โดยใช้ “บัตรอวยพร” หรือ “การอวยพรผ่านสื่อออนไลน์” แทนการมอบสิ่งของ เพื่อร่วมกันขับเคลื่อนนโยบายงดรับของขวัญอย่างเป็นรูปธรรม
CMU Law Engages Academic Staff to Reinforce “No Gift Policy” and Promote Organizational Integrity
Assistant Professor Dr. Chainarong Luengvilai, Dean of the Faculty of Law, Chiang Mai University, presided over the academic staff meeting on June 12, 2026, at 09:30 AM in Room 1201. The meeting aimed to communicate and emphasize the “No Gift Policy” guidelines to faculty executives and members.
The session focused on cultivating conscientiousness and establishing an institutional culture of transparency. All executives, faculty members, and personnel are strictly requested to decline all forms of gifts and tokens of appreciation arising from the performance of their duties on all occasions and during all festivals. The core guidelines are established as follows:
📌 Core Policy (No Gift Policy)
All executives, faculty members, and staff “SHALL NOT ACCEPT” gifts, tokens, or any other benefits from the performance of their duties under any circumstances—before, during, or after the execution of their responsibilities.
🎯 Policy Objectives
- To prevent corruption and misconduct.
- To eliminate the exercise of discretion or decision-making in academic and administrative duties that may lead to discrimination or create conflicts of interest.
- To encourage all personnel to perform their duties with honesty and professional integrity.
⚖️ Exceptions for Gift Acceptance
If it is necessary to give or receive gifts in accordance with ethical standards or traditional customs, personnel must strictly comply with:
- The Regulations of the Office of the Prime Minister on the Giving or Receiving of Gifts by State Officials, B.E. 2565 (2022).
- The Announcement of the National Anti-Corruption Commission (NACC) prescribing the criteria for the acceptance of assets or other benefits on ethical grounds by state officials, B.E. 2563 (2020).
💌 Alternative Practices
The Faculty of Law highly encourages expressing congratulations or seasonal goodwill through “Greeting Cards” or “Online Greetings” instead of giving physical objects or gifts.
